J&J pleased Chinese anti-monopoly dispute is over

BEIJING (AP) - Health care giant Johnson and Johnson says it is pleased to put a legal dispute behind it after a Chinese court ordered it to pay compensation to a former distributor under an anti-monopoly law.

Thursday's ruling said Johnson & Johnson was guilty of "vertical monopoly" for setting minimum prices its distributors charged for surgical sutures. It noted that J&J has stopped that practice but ordered it to pay 530,000 yuan ($85,000) to a Chinese distributor that said it lost potential sales due to the restriction.

"While we are disappointed with today's ruling by the Higher People's Court of Shanghai, we are pleased to have put this matter behind us and look forward to continuing to provide our high quality products and services to healthcare institutions and patients in China," said J&J in a statement.

Lawyers said the ruling indicates Chinese authorities are stepping up anti-monopoly investigations.

The ruling was the first of its kind against a Fortune 500 company under China's 5-year-old anti-monopoly law, according to lawyers and Chinese news reports.

Business groups welcomed the law in 2008 as a step toward making operating conditions clearer but have said since then it is enforced more actively against global companies than against their local rivals.

The case comes amid separate Chinese investigations of possible bribery, price-fixing and other misconduct by global suppliers of milk, pharmaceuticals and other products.

BOSTON, Aug. 1, 2013 --?According to the latest research from Strategy Analytics, global smartphone shipments grew 47 percent annually to reach 230 million units in the second quarter of 2013. Android captured a record 80 percent share all smartphone volumes worldwide, while Microsoft solidified its position in third place.

Scott Bicheno, Senior Analyst at Strategy Analytics, said, "Global smartphone shipments grew 47 percent annually from 156.5 million units in Q2 2012 to 229.6 million in Q2 2013. Growth was driven by strong demand for Android models across all price-tiers in developed and developing markets, such as the US, China and Brazil. Android now accounts for an impressive 8 in 10 of all smartphones shipped on the planet."

Neil Mawston, Executive Director at Strategy Analytics, added, "The Android operating system captured a record 80 percent share of all smartphones shipped worldwide in the second quarter of 2013. Competitive licensing costs, numerous hardware partners and a large apps store continue to be among the main drivers of Android's success. Apple iOS reached 14 percent global smartphone share in the quarter, its lowest level since Q2 2010. Microsoft slotted into third position with 4 percent share, reaching its highest level in the global smartphone market for three years."

Linda Sui, Analyst at Strategy Analytics, added, "Microsoft is making steady progress in the smartphone market due to strong support from Nokia. However, we believe Microsoft's WP8 platform still needs to improve in at least two areas before it truly takes off. First, the license fee charged to smartphone makers for WP8 must be more competitive to compete with Android in lower price-bands. And second, Microsoft must dramatically accelerate its support for advanced technologies, such as octo-core chipsets, because WP8 continues to lag behind Android in the premium smartphone category."

Pacira Pharma pain drug fails late-stage trial

(Reuters) - Pacira Pharmaceuticals Inc said its lead drug did not meet the main goal in a late-stage trial of reducing pain for patients undergoing a surgical procedure called posterolateral thoracotomy.

Pacira said the company did not meet the main goal of reducing pain scores over 72 hours, compared with a placebo.

The results are from a second late-stage study of the drug, Exparel, which is already approved as a single-dose injection to treat postsurgical pain.

'Undy' event to raise colon cancer funds, awareness | VUMC ...

Vanderbilt will add a new race event, the 2013 Nashville Undy 5000, to the list of affiliated events for the upcoming fall season.

The Undy 5000 is a 5K and 1-mile fun run dedicated to raising awareness and funds for colon cancer.

The race/walk will be held Saturday, Aug. 17, at the Walk of Fame Park next to the Downtown Hilton hotel, 121 Fourth Ave. S.

Participants are encouraged to wear their most outrageous underwear for the family-friendly event ? this brings a fun twist to the race while raising awareness about a very serious topic.
Vanderbilt-Ingram Cancer Center is sponsoring the event, which is hosted by the Colon Cancer Alliance, a nonprofit organization dedicated to colon cancer research, prevention efforts and patient support. This is the second year that the event has been held in Nashville.

?I am very excited about this event. As a colon and rectal surgeon, I treat patients with this cancer on a daily basis,? said Roberta Muldoon, M.D., assistant professor of Surgery. ?It is so important to get the message out that this disease is preventable and if caught early is curable. The key is in appropriate screening.?

Colorectal cancer is one of the most common cancers in the United States. According to the National Cancer Institute, more than 142,000 people will be diagnosed with the illness this year and approximately 50,830 patients will die from this form of cancer.

Screening tests, including fecal occult blood tests, sigmoidoscopy and colonoscopy, are the best methods to prevent the disease or catch it in early stages when it is most likely to be cured. Advancing age, a family history of colorectal cancer, alcohol use, cigarette smoking and obesity are all risk factors for the disease.

During the Aug. 17 event, participants can sign in beginning at 7:30 a.m. The 5K kick-off is slated for 8:30 a.m., and the 1-mile fun run follows at 8:40 a.m. The awards ceremony, which includes a special survivors? event, is scheduled for 9:35 a.m.

Edward Snowden has said that he still has more information about the NSA than what he's already leaked, and we're now getting a look at another big piece of that. According to a new set of documents provided to The Guardian, the NSA is using a tool called XKeyscore that is said to be its "widest reaching" system for collecting information from the internet -- one that lets it examine "nearly everything a typical user does on the internet," as one presentation slide explains. That apparently includes both metadata and the contents of emails, as well as social media activity, which can reportedly be accessed by NSA analysts without prior authorization; as The Guardian notes, a FISA warrant is required if the target of the surveillance is a US citizen, but not if a foreign target is communicating with an American.

According to The Guardian, the amount of data collected is so large that content is only able to stored in the system for three to five days, or as little as 24 hours in some cases, while metadata is stored for 30 days. That's reportedly led the NSA to develop a multi-tiered system that lets it move what's described as "interesting" content to other databases where it can be stored for as much as five years. In a statement provided to The Guardian, the NSA says that "XKeyscore is used as a part of NSA's lawful foreign signals intelligence collection system," and that "allegations of widespread, unchecked analyst access to NSA collection data are simply not true. Access to XKeyscore, as well as all of NSA's analytic tools, is limited to only those personnel who require access for their assigned tasks." The agency further adds that "every search by an NSA analyst is fully auditable, to ensure that they are proper and within the law."

The Brumbies and the Chiefs face off in the final of the Super XV this weekend and if it lives up to what went before then rugby fans are in for a treat.

It might be a Bank Holiday weekend, but it?s well worth setting your alarm for early on Saturday morning (well, 8am isn?t THAT early) to catch the clash between the Brumbies and the Chiefs in the Super XV final in Hamilton.

We?ve waxed lyrical about the lads from Fox Sports Down Under on numerous occasions in the recent past and to set the mood for the big one this weekend, they?ve cobbled together a five-minute highlight reel of the best moments from Super Rugby finals since the inauguration of the competition in 1996.

There are some memorable moments in there, from a George Smith-inspired Brumbies victory in 2004, the incredibly close all-South African encounter in 2007 and of course, Will Genia?s memorable individual try in Queensland Reds? triumph over the Crusaders in 2011.

Can the Chiefs and the Brumbies live up to what?s gone before this weekend? We wouldn?t bet against it.

Facebook may face prosecution over Carolina Picchio's suicide in Italy

Novara, Italy (CNN) -- Like many girls her age, Italian teenager Carolina Picchio shared her pictures, thoughts and emotions on Facebook.

But after a video of the 14-year-old allegedly showed up on Facebook in which she appeared to be drunk and disoriented at a party, social media became a source of torment.

In a wired world, children unable to escape cyberbullying

An ex-boyfriend and his friends posted a steady barrage of abusive, offensive messages aimed at Carolina. And what started out online spilled into her daily life at school, and among her friends in the prosperous northern Italian town of Novara.

Unbeknown to her family, it all became too much for her to handle. In the early hours of January 5, she jumped out of her bedroom window, landing headfirst on the concrete below.

Thousands of messages

Carolina's sister, Talita, and some of the teenager's friends say they reported the abusive messages from her ex-boyfriend to Facebook in the hope they would be removed. But, they say, nothing happened.

When bullying goes high-tech

"He was insulting her, mistreating her," Talita said. "We naturally spoke about it with her but she told us not to worry."

Now the Novara prosecutor, Francesco Saluzzo, is looking into the possibility of filing a criminal complaint against Facebook for failing to remove offensive content that may have led to Carolina's suicide.

"In the case of Carolina, it appears some of her friends, some of her relatives, asked for the removal of some of this strong content, and it wasn't removed -- and this played a role in her decision to commit suicide," he said.

Besides the abusive messages on Facebook, on the day leading up to her death, Carolina had received 2,600 vulgar messages via the messaging service WhatsApp, the prosecutor's documents show.

'Have you hurt me enough?'

Carolina left a final letter addressed to her tormenters, which her mother, Cristina Zocca, shared with CNN.

"Are you happy now?" the teenager asked. "Have you hurt me enough? Have you had enough revenge?"

Asked for the company's response, a spokesman for Facebook said, "We are deeply saddened by the tragic death of Carolina Picchio and our hearts go out to her family and friends.

How to protect your child from online bullies

"Harassment has no place on Facebook and we actively encourage teens and parents to report incidences of bullying using the links located throughout the site.

"We remove content reported to us that violates our Statement of Rights and Responsibilities and we escalate reports of harassment and bullying to law enforcement where appropriate."

Italian media reported in May that eight teenage boys ages 15 to 17 were being questioned by authorities on suspicion of incitement to suicide and possession of child pornography.

But Carolina's mother believes Facebook and other social networks must do more to confront the reality of online bullying.

"My battle is to make the social networks responsible, so that there are protections for minors," she said.

"We can't allow for more Carolinas, or other mothers who must cry and be deprived of the lives of their daughters."

Carolina's uncle has posted a video on YouTube dedicated to the teenager and her death.

It has become a rallying point in Italy for the fight against online bullying.
